Commercial Disputes & IPR

Contract and business disputes, and the protection and enforcement of intellectual property rights.

The firm advises and represents businesses in commercial disputes, including disputes arising from contracts, supply and service arrangements, partnerships, shareholder and joint-venture relationships, and the recovery of money. Matters are pursued before civil courts, commercial courts, tribunals and arbitral panels, and the firm also explores negotiated and mediated settlement where it serves the client’s commercial interest.

The firm also assists clients in protecting and enforcing their intellectual property rights, including trade marks, copyright, designs and patents. This includes advising on registration and licensing, sending notices and pursuing infringement and passing-off proceedings, and defending clients against such claims.

With two Advocates-on-Record on the team, the firm also handles Supreme Court filings of all kinds arising from commercial and intellectual property disputes.

What we handle

  • Contractual disputes, including supply, service, distribution and project agreements
  • Shareholder, partnership and joint-venture disputes
  • Recovery of money, and enforcement of decrees and awards
  • Trade mark, copyright and design matters: registration, licensing, infringement and passing off
  • Patent advice and disputes
  • Pre-litigation notices, injunctions and interim relief

Where we appear

Commercial Courts and civil courts; the High Courts; arbitral tribunals; the Supreme Court of India. Appeals in intellectual property matters lie to the High Courts.

Our approach

Commercial disputes are won or lost on the contract and the documents. We start with what the paper supports, advise candidly on the strength of the claim and the cost of pursuing it, and keep a negotiated or mediated outcome open throughout.
